In Illinois, you can get a DUI if you drive or are in physical control of a vehicle with a BAC of .08% or higher, no matter if your driving ability was actually impaired. In addition, you can get a DUI for driving or being in physical control of a vehicle while on drugs. Keep in mind, if you’re driving or in physical control of a vehicle, you automatically consent to submit a chemical test to determine your BAC level.

The following are the penalties for DUI in Illinois:

  • First-time DUI – Class A misdemeanor

    • Maximum jail sentence of one year

    • Fines of up to $2,500 (mandatory minimum of $500)

    • Post-conviction license suspension for one year (pre-conviction license suspension of three months)

  • Second-time DUI (within 20 years) – Class A misdemeanor

    • Maximum jail sentence of one year (mandatory minimum of 5 days)
    • Fines of up to $2,500
    • Post-conviction license suspension of five years (pre-conviction license suspension of one year)
  • Third-time DUI – Class 2 felony

    • Maximum prison sentence of seven years (mandatory minimum of 10 days)
    • Fines of up to $25,000
    • Post-conviction license suspension of 10 years (pre-conviction license suspension of one year)
