In the state of Illinois, the criminal charge of battery (720 ILCS 5/12-13) is defined as "the act of intentionally causing bodily harm to another person or making physical contact of an insulting or provoking nature."

How Is Assault Different from Battery?

An assault charge differs from battery in that it does not require that any physical contact be made between the alleged victim and the accused person. Assault can be charged as a misdemeanor or a felony and if convicted is punishable by jail or prison time and fines of up to $25,000. If assault is committed against a law enforcement officer, senior citizen, or a teacher, it is charged as a felony. If a weapon is used, a simple assault can be charged as a felony aggravated assault.
