Armed Robbery Penalties

Armed robbery occurs when a person takes property from another individual, accompanied by the use of force or the threat of imminent force, while in possession of a firearm or other dangerous weapon.

The prosecution must prove beyond a reasonable doubt that:

• An individual took property from another person
• The offender carried the property away
• The offender had the intention to deprive the possessor of the property permanently
• The taking was accomplished by the use of force or the threat of imminent force
• The offender used a firearm or other dangerous weapon during the commission of the robbery

Armed robbery is considered a Class X felony, which is punishable by a prison sentence between six and 30 years. However, if the offender is carrying a firearm as opposed to another type of deadly weapon, 15 years can be added to the sentence. If the offender discharges the weapon during the commission of the robbery, 20 years can be added to the sentence.
