Manslaughter Penalties

There are two types of manslaughter charges in Illinois, voluntary and involuntary:

  • Voluntary manslaughter - is the killing of a person in which the offender had no prior intent to kill and acted during “the heat of passion.” In Illinois, it often only applies to the killing of an unborn child. This type of manslaughter charge is considered a Class 1 felony, which is punishable by a prison sentence between four and 15 years and a fine of up to $25,000.
  • Involuntary manslaughter - is defined as the unintentional killing derived from recklessness and criminal negligence, or from an unlawful act that is considered a misdemeanor or a low-level felony (e.g. DUI). This type of manslaughter charge is a Class 3 felony, which is punishable by a prison sentence between two and five years, as well as a fine of $25,000.
